CONSUMER HEALTH DATA PRIVACY POLICY

This Consumer Health Data Privacy Policy supplements the general Privacy Policy of Proof Investments LLC, doing business as Proof Cocktails & Lounge (“Proof,” “we,” “us,” or “our”). It describes how we collect, use, and disclose consumer health data subject to the Washington My Health My Data Act and explains the rights available under that law.

Consumer Health Data We May Collect

​

“Consumer health data” means personal information that is linked or reasonably linkable to a consumer and identifies or reveals information about the consumer’s physical or mental health.

Proof may collect limited consumer health data that a guest voluntarily provides, including:

​

  • Food allergy, sensitivity, or intolerance information.

  • Dietary restrictions that reveal or may reasonably indicate health information.

  • Mobility, visual, hearing, communication, or other accessibility needs.

  • Requests for seating, service, or other accommodations related to a health condition or disability.

  • Other health-related information included in reservation notes, event inquiries, emails, telephone calls, or direct communications with our staff.

Please provide only the information reasonably necessary for us to understand and fulfill your request. A diagnosis or detailed medical history is ordinarily not needed.

Sources of Consumer Health Data

​

We may collect consumer health data directly from:

​

  • You or someone acting on your behalf.

  • Reservation, ordering, or event-inquiry forms.

  • Toast or another provider you use to submit a reservation or service request.

  • Emails, telephone calls, or in-person communications.

  • Event organizers or members of your party who request an accommodation on your behalf.

Why We Collect and Use Consumer Health Data

​

We may collect and use consumer health data to:

​

  • Provide food, seating, accessibility, communication, or other accommodations you request.

  • Help our staff safely prepare and serve food and beverages.

  • Respond to questions or concerns about ingredients and menu items.

  • Coordinate reservations, private events, and guest experiences.

  • Communicate with you about your request.

  • Maintain appropriate business records.

  • Comply with legal obligations.

  • Protect the health and safety of guests, employees, and others.

  • Establish, exercise, or defend legal claims.

We collect and use this information only as reasonably necessary to provide a product, service, or accommodation you requested, as otherwise permitted by law, or with your consent when consent is required.

We will not collect additional categories of consumer health data or use collected consumer health data for materially different purposes without first updating this policy and obtaining consent when required.

Consumer Health Data We May Share

​

The categories of consumer health data we may share are food allergy or intolerance information, health-related dietary restrictions, accessibility or accommodation information, and other health-related information you voluntarily provide for a requested service.

Depending on the request, these categories may be shared with:

  • Proof employees who need the information to prepare food, manage a reservation, provide service, or fulfill an accommodation.

  • Reservation, ordering, event-management, customer-service, hosting, information-technology, security, or data-storage providers acting on our behalf, including Toast, when reasonably necessary to provide the requested service.

  • Attorneys, insurers, consultants, or other professional advisers when reasonably necessary and permitted by law.

  • Government agencies, regulators, courts, law enforcement, or other parties when disclosure is required or permitted by law.

  • Other parties only at your direction, with your consent when required, or when reasonably necessary to provide a product, service, or accommodation you requested.

Specific affiliates receiving consumer health data: None.

​

Proof does not sell consumer health data. We do not use consumer health data for targeted advertising.

We do not authorize Google, Meta, email-marketing providers, or other advertising and analytics providers to collect information entered into dietary, allergy, accessibility, employment, payment, or reservation-form fields for advertising purposes.

Your Consumer Health Data Rights

​

Subject to applicable law, you have the right to:

  • Confirm whether Proof is collecting, sharing, or selling consumer health data about you.

  • Access the consumer health data Proof maintains about you.

  • Receive a list of third parties and affiliates with whom your consumer health data has been shared or sold, including contact information when required.

  • Withdraw consent to future collection or sharing of your consumer health data.

  • Request deletion of your consumer health data.

  • Appeal a refusal to act on a request.

Proof does not sell consumer health data.

How to Exercise Your Rights

​

To initiate a request, email info@theproofbar.com with “Consumer Health Data Request” in the subject line or call 360-314-6994. Please do not include allergy information, diagnoses, disability details, identification documents, or other sensitive information in an unencrypted email. We will provide instructions for securely verifying and processing your request.

​

You do not need to create a new account to make a request. We may request information reasonably necessary to authenticate your identity and protect your information. If someone submits a request on your behalf, we may take reasonable steps to verify that person’s authority to act for you.

​

We will respond without undue delay and ordinarily within 45 days after receiving the request. When reasonably necessary, we may extend the response period once by an additional 45 days. If an extension is needed, we will notify you within the initial 45-day period and explain the reason.

​

Requests will be processed free of charge up to twice annually. We may charge a reasonable fee or decline to act if a request is manifestly unfounded, excessive, or repetitive, as permitted by law. Deletion from archived or backup systems may be delayed for up to six months when permitted by law.

Appeals

​

If we decline to act on your request, you may appeal by emailing info@theproofbar.com with “Consumer Health Data Appeal” in the subject line or by calling 360-314-6994. Please identify the original request and explain why you believe the decision should be reconsidered.

We will respond to the appeal in writing within 45 days. If an appeal is denied, you may contact the Washington State Attorney General or submit a complaint at www.atg.wa.gov/file-complaint.

Security and Access Controls

​

We limit access to consumer health data to employees, processors, contractors, and service providers who reasonably need the information to provide the requested service or accommodation. We use reasonable administrative, technical, and physical safeguards appropriate to the nature and volume of the data. No method of electronic transmission or storage can be guaranteed to be completely secure.

 

Retention

​

We retain consumer health data only for as long as reasonably necessary to fulfill the requested service or accommodation, maintain appropriate business records, comply with legal obligations, resolve disputes, or establish, exercise, or defend legal claims. Proof maintains internal retention procedures designed to limit unnecessary retention.

Changes to This Policy

​

We may update this Consumer Health Data Privacy Policy periodically. We will post the revised policy with an updated effective date. Before collecting new categories of consumer health data or using consumer health data for materially different purposes, we will provide additional notice and obtain consent when required by law.
